priistas nombramiento en Auditor\u00eda: Gaby Bernal"},"content":{"rendered":"<p><strong>Chilpancingo, Gro.-<\/strong> La designaci\u00f3n de Natividad P\u00e9rez Guinto como encargada de la Auditor\u00eda Superior del Estado, hecha por el presidente de la Junta de Coordinaci\u00f3n Pol\u00edtica, Alfredo S\u00e1nchez Esquivel, es ilegal porque no cumple con los requisitos de validez, acus\u00f3 la diputada local Gabriela Bernal Res\u00e9ndiz.<\/p>\n<p>La legisladora priista, en conferencia de prensa y a nombre de la bancada priista, sostuvo que el nombramiento debe ser hecho por el pleno del Congreso del Estado que es el \u00fanico facultado para designar a la persona que ocupar\u00e1 la titularidad o el encargo del despacho de dicho \u00f3rgano.<\/p>\n<p>Se\u00f1al\u00f3 que, constitucionalmente, la Auditor\u00eda Superior del Estado es un \u00f3rgano auxiliar del Congreso del Estado con autonom\u00eda t\u00e9cnica para realizar sus funciones referentes a la facultad de fiscalizaci\u00f3n de los recursos p\u00fablicos estatales.<\/p>\n<p>Record\u00f3 que el 20 de julio del 2021 Alfonso Dami\u00e1n Peralta concluy\u00f3 su periodo como auditor y le correspond\u00eda suplirlo hasta el 16 de enero del 2022 al entonces auditor Especial del Sector Gobierno quien present\u00f3 su dimisi\u00f3n a esa responsabilidad y, por prelaci\u00f3n, le correspond\u00eda a P\u00e9rez Guinto la titularidad por ser auditora especial de evaluaci\u00f3n del desempe\u00f1o, \u00fanica que segu\u00eda en ejercicio del cargo.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2992\" src=\"https:\/\/expresionesguerrero.com.mx\/expresioneswp\/wp-content\/uploads\/2022\/02\/gaby.jpg\" alt=\"\" width=\"597\" height=\"674\" srcset=\"https:\/\/expresionesguerrero.com.mx\/expresioneswp\/wp-content\/uploads\/2022\/02\/gaby.jpg 597w, https:\/\/expresionesguerrero.com.mx\/expresioneswp\/wp-content\/uploads\/2022\/02\/gaby-266x300.jpg 266w\" sizes=\"auto, (max-width: 597px) 100vw, 597px\" \/><\/p>\n<p>Sin embargo, asumiendo facultades que no le corresponden, el presidente de la Jucopo, Alfredo S\u00e1nchez Esquivel, emiti\u00f3 un documento mediante el cual designa encargada de despacho de la ASE a Natividad P\u00e9rez Guinto y procedi\u00f3 a emitir nombramientos de Auditores Especiales y directores generales.<\/p>\n<p>\u201cLa validez de los actos administrativos depende del cumplimiento de varios requisitos como son el cabal acatamiento de la norma y preceptos jur\u00eddicos, la competencia que la persona p\u00fablica puede leg\u00edtimamente ejercer, la formalidad del acto que se conjugan en la forma y el procedimiento, adem\u00e1s de un razonamiento correcto y l\u00f3gicamente sustentado\u201d.<\/p>\n<p>A\u00f1adi\u00f3 que es fundamental recordar que en el Estado de Derecho se proscribe la arbitrariedad en el ejercicio de la autoridad y del poder p\u00fablico, de modo que las actuaciones de la administraci\u00f3n p\u00fablica deben estar estrictamente apegadas a las disposiciones jur\u00eddicas.<\/p>\n<p>La bancada priista, por consiguiente, consider\u00f3 que la designaci\u00f3n de encargada de despacho de la Auditor\u00eda Superior del Estado no cumple con los requisitos de validez jur\u00eddico y por ende es inv\u00e1lida e ilegal y arremeti\u00f3 que los actos emanados de quien acept\u00f3 y asumi\u00f3 tal designaci\u00f3n son igual de inv\u00e1lidos e ilegales porque no se cumplen los requisitos de validez del acto jur\u00eddico.<\/p>\n<p>Bernal Res\u00e9ndiz indic\u00f3 finalmente, a nombre de los priistas, que presidente de la Junta de Coordinaci\u00f3n Pol\u00edtica no es capaz, su voluntad no est\u00e1 exenta de vicios y no reviste la forma que la ley exige.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chilpancingo, Gro.- La
