{"id":14686,"date":"2026-07-07T01:07:58","date_gmt":"2026-07-07T06:07:58","guid":{"rendered":"https:\/\/expresionesguerrero.com.mx\/expresioneswp\/?p=14686"},"modified":"2026-07-07T01:08:00","modified_gmt":"2026-07-07T06:08:00","slug":"se-aclara-competencia-no-cierre-de-investigaciones-corte","status":"publish","type":"post","link":"https:\/\/expresionesguerrero.com.mx\/expresioneswp\/?p=14686","title":{"rendered":"Se aclara competencia no cierre de investigaciones: Corte"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN) anul\u00f3 una auditor\u00eda efectuada por el \u00f3rgano fiscalizador de Guerrero, al establecer que la Auditor\u00eda Superior del Estado, carece de facultades para revisar recursos federales ejercidos por el municipio de Acapulco, dando la raz\u00f3n a la alcaldesa, Abelina L\u00f3pez.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Empero, el m\u00e1ximo tribunal del pa\u00eds se\u00f1al\u00f3 que la investigaci\u00f3n sobre el manejo de casi 899 millones de pesos puede continuar por la v\u00eda federal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La auditor\u00eda invalidada ten\u00eda como prop\u00f3sito fiscalizar el destino de 898.6 millones de pesos correspondientes al Fondo de Aportaciones para la Infraestructura Social Municipal y de las Demarcaciones Territoriales, FAISMUN.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Los ministros manifestaron que la resoluci\u00f3n no implica el cierre de las investigaciones sobre el manejo de esos recursos ni representa una exoneraci\u00f3n para las autoridades municipales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El ministro ponente, Ar\u00edstides Guerrero Garc\u00eda, coment\u00f3 que el fallo se limita a definir cu\u00e1l es la autoridad competente para realizar la fiscalizaci\u00f3n de los recursos federales, competencia que, conforme a la Constituci\u00f3n, corresponde exclusivamente a la Auditor\u00eda Superior de la Federaci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEl proyecto propone declarar la invalidez del informe individual de auditor\u00eda impugnado, as\u00ed como del oficio ACE 1380 diagonal 2025, insisto, un tema de precedentes, un tema de competencia\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHay que se\u00f1alarlo tambi\u00e9n en la propuesta del proyecto\u2026 No se exime ning\u00fan tipo de fiscalizaci\u00f3n de los recursos federales por parte del municipio actor ni se pronuncia sobre el fondo de su manejo. Resuelve \u00fanicamente cu\u00e1l es la autoridad constitucionalmente competente para revisarlos\u201d, refiri\u00f3 el ministro.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Suprema Corte
