Hacienda deber\u00e1 devolverle m\u00e1s de 60 millones de euros"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>MADRID, Espa\u00f1a, 18 de mayo de 2026.-<\/strong> La cantante colombiana Shakira obtuvo una resoluci\u00f3n favorable de la justicia espa\u00f1ola luego de que la Audiencia Nacional anul\u00f3 las multas y liquidaciones fiscales que le hab\u00eda impuesto la Agencia Tributaria por el ejercicio fiscal de 2011.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Con esta decisi\u00f3n, Hacienda deber\u00e1 devolverle a la artista m\u00e1s de 60 millones de euros \u2014equivalentes a unos 70 millones de d\u00f3lares\u2014, incluyendo intereses y costas judiciales, seg\u00fan inform\u00f3 el equipo legal de la int\u00e9rprete.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-wp-embed is-provider-expresiones-guerrero wp-block-embed-expresiones-guerrero\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"wp-embedded-content\" data-secret=\"wweF8DhLg8\"><a href=\"https:\/\/expresionesguerrero.com.mx\/expresioneswp\/?p=14008\">M\u00e9xico revela prelista de 55 jugadores para Mundial 2026<\/a><\/blockquote><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; visibility: hidden;\" title=\"\u00abM\u00e9xico revela prelista de 55 jugadores para Mundial 2026\u00bb \u2014 Expresiones Guerrero\" src=\"https:\/\/expresionesguerrero.com.mx\/expresioneswp\/?p=14008&#038;embed=true#?secret=S3vRRqa6qb#?secret=wweF8DhLg8\" data-secret=\"wweF8DhLg8\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Tribunal concluye que Shakira no residi\u00f3 m\u00e1s de 183 d\u00edas en Espa\u00f1a<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La sentencia establece que la administraci\u00f3n tributaria espa\u00f1ola no logr\u00f3 acreditar que Shakira permaneciera en Espa\u00f1a m\u00e1s de 183 d\u00edas durante 2011, requisito indispensable para considerarla residente fiscal y obligarla a pagar el Impuesto sobre la Renta de las Personas F\u00edsicas (IRPF).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acuerdo con la Audiencia Nacional, la cantante \u00fanicamente estuvo 163 d\u00edas en territorio espa\u00f1ol ese a\u00f1o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El tribunal tambi\u00e9n determin\u00f3 que Hacienda no pudo demostrar que la artista tuviera en Espa\u00f1a el n\u00facleo principal de sus intereses econ\u00f3micos o familiares.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Relaci\u00f3n con Gerard Piqu\u00e9 no acreditaba residencia fiscal<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Las autoridades fiscales hab\u00edan argumentado que Gerard Piqu\u00e9, entonces pareja sentimental de Shakira, resid\u00eda en Espa\u00f1a y eso acreditaba v\u00ednculos suficientes para establecer residencia fiscal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sin embargo, la justicia espa\u00f1ola concluy\u00f3 que en 2011 no exist\u00eda \u201cv\u00ednculo conyugal\u201d entre ambos, ya que nunca estuvieron casados, ni ten\u00edan hijos menores residiendo en el pa\u00eds, por lo que no pod\u00eda considerarse un n\u00facleo familiar legal.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cNo exist\u00eda un n\u00facleo familiar a efectos legales de una persona extranjera\u201d, se\u00f1ala la resoluci\u00f3n judicial.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Hacienda recurrir\u00e1 la decisi\u00f3n<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aunque la sentencia representa una victoria para Shakira, la Agencia Tributaria espa\u00f1ola confirm\u00f3 que recurrir\u00e1 el fallo ante el Tribunal Supremo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El caso formaba parte de una disputa fiscal que la cantante manten\u00eda en Espa\u00f1a desde hace ocho a\u00f1os.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Shakira ya hab\u00eda aceptado otra multa en 2024<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pese a esta resoluci\u00f3n favorable, la artista s\u00ed reconoci\u00f3 anteriormente responsabilidades fiscales correspondientes a otros ejercicios.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En 2024, Shakira acept\u00f3 pagar una multa de 7.8 millones de euros tras admitir judicialmente que defraud\u00f3 14.5 millones de euros entre 2012 y 2014, acuerdo que le permiti\u00f3 evitar un juicio prolongado y una posible pena de prisi\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adem\u00e1s, hace unos d\u00edas, un juzgado de Barcelona archiv\u00f3 otra causa penal abierta contra la cantante por un supuesto fraude fiscal de 6.6 millones de euros relacionado con 2018.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La justicia espa\u00f1ola anul\u00f3 multas y sanciones fiscales contra la cantante colombiana por el ejercicio fiscal de 2011<\/p>\n","protected":false},"author":1,"featured_media":14150,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","footnotes":""},"categories":[7],"tags":[1888,1889,1886,1887,1885,1890,1891,1884,1892,1893],"class_list":["post-14149","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-mundo","tag-audiencia-nacional","tag-devolucion-millonaria","tag-fraude-fiscal-shakira","tag-gerard-pique","tag-hacienda-espana","tag-impuestos-espana","tag-multa-fiscal-shakira","tag-shakira","tag-shakira-2026","tag-tribunal-supremo"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.1 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Tribunal espa\u00f1ol falla a favor de Shakira;
